Judicial Misconduct Alleged In Donofrio’s Obama Eligibility Suit

Last night, Leo Donofrio returned to Lan Lamphere’s Overnight AM radio with some disturbing hews about his current litigation vs. the NJ Secretary of State concerning Barack Obama’s eligibility to run for President. Donofrio’s suit is scheduled for conference by the Supreme Court December 5th; however, it is seemingly being interfered with before the Court holds it’s conference.
So yesterday, Donofrio filed, with the NJ Supreme Court’s Advisory Committee on Judicial Conduct, an official allegation of Judicial Misconduct against Appellate Division Judge Jack M. Sabatino with regard to the initial stage of this litigation which was originally filed in the NJ Superior Court, Appellate Division. The case, having come directly from an appeal to the New Jersey Supreme Court is now before the the United States Supreme Court, “DISTRIBUTED for Conference of December 5, 2008″ before all nine Supreme Court Justices. Leo said that:
I am very concerned that if the United States Supreme Court requests the official records of the case from the NJ Appellate Division, a fraudulent case file – not including all relevant documents – will be forwarded to the SCOTUS and thereby the case now pending might be jeopardized.
While Donofrio was on Overnight AM last night, reviewing the legalities of this concern, Donofrio’s website was suddenly attacked and shut down. The Patriot Brigade, Overnight AM’s core listeners, acted quickly and grabbed the Google cache of the website, which is currently viewable at www.naturalborncitizen.org. Then, something even more strange happened. For reasons still unknown, Overnight AM’s 5 separate servers, located around the country, were flooded and knocked out. The active chat room for the show revealed listener after listener losing the audio from all internet radio sources, including iTunes.
Donofrio’s suit is considered by many to be the best positioned of all pending lawsuits concerning Barack Obama’s eligibility to be President; it claims Obama is not a natural born citizen, and had British citizenship at birth due to his father’s citizenship status. Donofrio’s suit was fast-tracked by the Supreme Court, an extremely rare occurrence. Before last night, all of the filings, arguments and litigation could be seen on Donofrio’s website, but the site is having to be rebuilt today. I’m not sure these happenings were a coincidence at all. The show was recorded, as usual, and is currently in replay. It will be in archive at Overnight AM shortly. The show is well worth a listen, especially for those thousands and thousands of listeners who were knocked off last night. On Dec 5 the Supreme Court will either allow or disallow the usurpation of both the Constitution and the Government of the United States — easily the most pivotal decision since our nation’s founding — and the silence of the news media is deafening (if not downright scary).

“Dirty Pool” at the Supreme Court apparently on behalf of Obama currently usurping YOUR Constitution: Leo Donofrio’s companion case, brought by Cort Wrotnowski, with fuller/better briefing showing Obama is not an Article II “natural born citizen” reportedly has been sidetracked to the anthrax lab to deprive the full Court from seeing those filings in connection with Donofrio’s case this Friday, Dec 5, 2008. DO SOMETHING AMERICA!!!

As Donofrio’s own lawsuit acknowledges, there is NO QUESTION that Obama was born in Hawaii. Donofrio doesn’t dispute that. He’s just making the totally specious argument that being born in the US to a British father (or a possibly British father) somehow causes you not to be born a US citizen.
If you are born on US soil to a British father and an American mother, there are only two possible results: (1) you are born with dual nationality (i.e. you’re born a citizen of both Britain and the US), or (2) you are born a citizen of the US. There is no third option under which you would be born a British citizen but NOT an American citizen. So Obama was born an American citizen, as the Constitution requires. Donofrio needs to get his head out of his ass.

PS A good friend of mine was born to a British father and an American mother IN LONDON, ENGLAND, and she was born a dual national (US and British). I mention this just to illustrate the total ludicrousness of arguing that being born ON US SOIL to the same mix of parents (US mom/UK dad) somehow causes you not to be born an American citizen.

@Mimi: You nearly got Donofrio’s argument correct. Yes, he is arguing that Obama had dual citizenship at birth and THAT is the problem. He is arguing that the Constitution specifies an individual must have always had only ONE citizenship to be eligible for the presidency.
He is not saying Obama isn’t an American citizen. He is saying that Obama is an American citizen PLUS a UK citizen and that is the problem.

@Matt: In addition to being totally specious in that it’s based on absolutely no actual law, Donofrio’s argument means the Republican candidate (McCain) was equally ineligible to be president. By virtue of his birth to American parents in the Panama Canal Zone, McCain was born an American and a Panamanian citizen. My grandma was the same: born to American parents in the PCZ, she was both a Panamanian and an American citizen.
