Last week Obama passed an order saying he wants to close the Guantanamo Bay prison within the next year. The media generally presented this executive order as a definitive end-of-Gitmo fact rather than more of a goal, but that’s beside the point right now. What is important is that a judge at Gitmo has refused Obama’s order to suspend the trial of Abd al-Rahim al-Nashiri who has been implicated in the 2000 attack on the USS Cole in Yemen which left 17 American sailors dead.

Judge James Pohl denied the motion” put forward by the prosecution at the request of Obama to suspend the trial for 120 days, said Defense Department spokesman J.D. Gordon, confirming a report by The Washington Post.

Saudi defendant Abd al-Rahim al-Nashiri, 43, was due to say whether he pleads guilty or not at a hearing set for February 9.

Following Judge Pohl’s decision, the new administration will now have to decide whether to withdraw the charges against Nashiri or not.

Seems like an easy decision to me. Let’s see how Barry handles it.
